1. The agreement
These Terms of Service ("Terms") form a binding agreement between you and Jellyfish, Inc. ("Jellyfish," "we," "us"). They apply when you create a Jellyfish account, use the app or website, or interact with our services in any other way. By using Jellyfish, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the service.
2. Who can use Jellyfish
- You must be at least 18 years old to create a Jellyfish account.
- You must be legally capable of entering into a binding contract under the laws of your jurisdiction.
- You must not be barred from using Jellyfish under applicable law.
- If you create an account on behalf of a venue or business, you represent that you have authority to bind that entity to these Terms.
3. Your account
You're responsible for keeping your account credentials secure and for everything that happens under your account. Use a strong unique password (or sign in via Apple/Google). If you suspect unauthorized access, email security@wejellyfish.com immediately.
You can delete your account anytime from Profile → Settings → Delete account. We'll remove your data per our Privacy Policy.
4. How to use Jellyfish
You agree not to:
- Use Jellyfish to harass, threaten, defame, or harm any person or business.
- Submit false pulse reports or fake check-ins to artificially inflate or deflate a venue's busyness.
- Create multiple accounts to evade suspension or skew metrics.
- Scrape, copy, reverse-engineer, or attempt to extract our underlying data, code, or models.
- Use the service to violate any law or any third party's rights.
- Send unsolicited messages or spam other users.
- Interfere with the security or integrity of the service.
- Misrepresent your identity or affiliation with any person or organization.
We may take action — including warning, suspending, or permanently banning your account — if we determine in our reasonable judgment that you've violated any of the above.
5. Your content
"Your content" means anything you submit to Jellyfish — pulse reports, profile info, taglines, plans, photos, comments, messages, etc.
You retain ownership of your content. By submitting it, you grant Jellyfish a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content within the service. This license is limited to operating the service and ends when you delete your content (subject to reasonable backup retention).
You're responsible for the accuracy and legality of your content. Don't post anything that's false, misleading, infringing, illegal, or that you don't have the right to post.
6. Jellyfish Pro subscription
Jellyfish Pro is an optional, recurring subscription. Pricing and features are described in the app and at /#pro. Pricing may vary by region.
- Billing: handled by Apple App Store or Google Play, not directly by us. Your subscription auto-renews until you cancel it. You'll be charged the renewal fee within 24 hours before the next period begins.
- Free trial: if your subscription includes a free trial, it converts to a paid subscription at the end of the trial period unless you cancel before that.
- Cancellation: cancel any time via App Store → Apple ID → Subscriptions (iOS) or Play Store → Account → Payments & subscriptions (Android). Cancellation stops the next renewal — you keep Pro features until your current period ends.
- Refunds: refund requests are handled by the platform you bought through (Apple or Google). We can't issue refunds directly.
- Price changes: if we change Pro pricing, we'll notify you at least 30 days before the next renewal so you can decide whether to stay subscribed.
7. Venue listings and accuracy
Venues displayed in Jellyfish are sourced from public databases, partner integrations, and our own research. We try to keep listings accurate but we don't guarantee correctness of hours, prices, photos, or descriptions. Always verify directly with the venue if it matters.
Live crowd levels are fused from multiple signals — anonymous geofence presence, user pulse reports, and historical forecasts. They are best estimates and may not always match the room. Use your judgment. We're not liable for disappointment about how a venue actually was.

8. Our rights
Jellyfish, the Jellyfish logo, and all related marks are our property. The service — including code, design, copy, and brand — is protected by copyright, trademark, and other intellectual-property laws. You may not use any of it without our written permission, except to the extent normal use of the service requires.
9. Suspension and termination
We may suspend or terminate your account or your access to the service at any time, with or without notice, if we reasonably believe you've violated these Terms or applicable law, or if continuing to provide the service to you would create legal or operational risk. We'll try to give you notice and reason where practical.
You may stop using Jellyfish anytime by deleting your account.
10. Disclaimers
Jellyfish is provided "as is" and "as available". We don't guarantee that the service will be error-free, uninterrupted, or perfectly accurate. We disclaim, to the fullest extent allowed by law, all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement.
You're responsible for your own safety when going out. Don't make decisions based solely on Jellyfish data — confirm a venue is open, safe, and appropriate before going. Drink responsibly. Use rideshare. Look out for your friends.
11. Limitation of liability
To the fullest extent permitted by law, Jellyfish is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or related to your use of the service.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the service is limited to the greater of $100 USD or the amount you paid us in the 12 months immediately preceding the event giving rise to the claim.
Some jurisdictions don't allow these limitations, so they may not apply to you to the extent prohibited by law.
12. Disputes and governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the service will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.
If you live somewhere where the law gives you the right to bring a claim in your local courts, this clause doesn't take that right away from you.
13. Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll notify you via in-app notice and email (if you've provided one) at least 30 days before they take effect. Continuing to use the service after changes take effect means you accept the updated Terms. If you don't accept them, stop using the service and delete your account.
